Definitions: Seller — the website owner; Consumer — a natural person making a purchase for purposes not directly related to their business or profession; Website — the sales platform at https://miriammay.com/.
The Website allows the purchase of products around the clock — personal-development workshops, mentoring, meditations and individual sessions, held online or live. Detailed prices, the programme and any stay-related costs are each time provided in the description of the given product.
Using the Website requires a device with Internet access and an up-to-date web browser with JavaScript and cookies enabled. The Seller is not liable for technical problems or limitations of the User's hardware or software that prevent or hinder use of the Website.
A purchase requires reviewing the purchasing rules, the price list (prices in PLN, including VAT) and these Terms. The contract is concluded upon placing the order, which is fulfilled without undue delay. The Consumer may choose proof of purchase (electronic or paper invoice, receipt), providing the data needed to issue it.
Online products are delivered by granting access in the User's account and sending information to the e-mail given in the order; live events — in the manner, time and place stated in the description.
The Consumer has the right to withdraw from the contract within 14 days of its conclusion (for live events — until the date stated in the description), without giving a reason, by sending a statement to [email protected] (or in another manner sufficiently expressing the intention to withdraw). A model withdrawal form is available on request.
Digital content. Pursuant to Art. 38(1)(13) of the Consumer Rights Act, the right of withdrawal does not apply if performance (granting the content or access) began with the Consumer's express and prior consent, after being informed of the loss of the right of withdrawal and acknowledging it. The Consumer gives this consent during checkout; once access is granted, the right of withdrawal expires.
Upon effective withdrawal the Seller returns all payments received without undue delay, no later than 14 days from receiving the statement, using the same payment method the Consumer used (unless they agree to another method at no cost to them). For live events the Seller may withhold a deposit in the amount and on the terms stated in the event description. The Seller promptly confirms receipt of the withdrawal statement electronically.
The right of withdrawal also does not apply in the other cases listed in Art. 38 of the Consumer Rights Act, including for services with characteristics specified by the Consumer or closely related to their person.
The Seller is liable to the Consumer for the lack of conformity of goods and of digital content or services with the contract, on the terms set out in the Consumer Rights Act. A complaint may be filed at [email protected] or in writing: PRAMATKA Iwona Miecznikowska, ul. Leśna 117B, 05-083 Wyględy, Poland.
A complaint should include: full name, contact details (e-mail, phone, address), the subject and reason for the complaint, and — for written complaints — a signature. Complaints are handled without undue delay, no later than within 14 days; the Seller informs the Consumer of the outcome at the address provided. Where justified, the Consumer is entitled to repair, bringing into conformity, a price reduction or withdrawal from the contract on statutory terms.
The Consumer may use out-of-court methods of handling complaints and pursuing claims, e.g. through the district (municipal) consumer ombudsman and the Office of Competition and Consumer Protection (uokik.gov.pl).
The controller of personal data is the Seller. Data is processed to fulfil the order and for the purposes set out in the Privacy policy available on the Website.
These Terms apply from the date of publication on the Website and form an integral part of the contract concluded with the User. The Seller reserves the right to amend the Terms; registered Users will be notified electronically 30 days before changes take effect. Changes do not worsen the legal position of Consumers, and orders started before the changes are fulfilled under the previous rules.
Matters not covered here are governed by Polish law, in particular the Civil Code, the Act on providing services by electronic means, the Consumer Rights Act and the GDPR.
